APS Transmission Cost Adjustor Charges

 

On Wednesday, May 20, 2009, Arizona Public Service Company (“APS” or “Company”) filed an application ("Application") with the Arizona Corporation Commission ("ACC" or "Commission") seeking approval of revised transmission charges to be recovered through the Company's transmission cost rate adjuster mechanism ("TCA") which was approved In Decision No. 67744, dated April 7, 2005.

APS' Application was filed pursuant to Decision No. 67744 and requests that the Commission approve transmission rates authorized by the Federal Energy Regulatory Commission (“FERC”) that will become effective for users of the APS transmission system as of June 1, 2009.

On Friday, May 22, 2009, RUCO filed a motion to intervene in the case on behalf of residential ratepayers.  RUCO's request was granted by the ACC Chief Administrative Law Judge ("CALJ") on Wednesday, June 3, 2009.

Because APS' Application is not seeking a permanent increase in utility rates, the Commission's time clock rules do not apply in this particular matter.  To date there has been no request for an evidentiary hearing on the matter, and no order governing the proceeding has been issued by the ACC's Hearing Division.

Depending on the course that the proceeding takes, a Recommended Opinion and Order ("ROO") will be issued by either ACC Staff or an Administrative law Judge (if a hearing is requested).  The ROO will then be voted on by the five sitting ACC Commissioners during a noticed Open Meeting.  The Commissioners can either accept, reject or amend the ROO.

No date on a final decision on APS' request can be estimated at this time.
